Currently, Kratom is legal and unclassified in Maine for adults to buy, sell, possess, and use. The federal government doesn’t regulate kratom, allowing each state to decide its own laws. Although the DEA once proposed banning kratom, public opposition prevented that from happening, and states like Maine have maintained their independence in regulating the plant.

In 2017, Senate Bill 1546 sought to ban kratom’s active ingredient, mitragynine, by classifying it as a Schedule W substance. However, lawmakers later removed kratom from the bill, keeping it legal. This remains the only major attempt to outlaw kratom in Maine.
