Currently, Kratom is legal and unclassified in Maine for adults to buy, sell, possess, and use. The federal government doesn’t regulate kratom, allowing each state to decide its own laws. Although the DEA once proposed banning kratom, public opposition prevented that from happening, and states like Maine have maintained their independence in regulating the plant.
Advocates are actively working so that Kratom remains legal.
In 2017, Senate Bill 1546 sought to ban kratom’s active ingredient, mitragynine, by classifying it as a Schedule W substance. However, lawmakers later removed kratom from the bill, keeping it legal. This remains the only major attempt to outlaw kratom in Maine.
The American Kratom Association (AKA) and Botanical Education Alliance (BEA) have been advocating for responsible kratom regulations through the Kratom Consumer Protection Act (KCPA).

For now, kratom is legal and unregulated in Maine. It’s easily available in smoke shops, wellness stores, and online marketplaces. However, residents should be cautious when traveling to states where kratom is banned.

The Transportation Security Administration (TSA) oversees security and has specific rules regarding various items, including Kratom.
While it's not a prohibited item, Kratom powders over 12 oz will be placed in a separate bin for X-ray screening. You can bring Kratom in your carry-on or checked luggage, but we recommend clearly labeleling the product to avoid any confusion.

A handful of countries where Kratom is ILLEGAL include:

There is no federal minimum age to purchase Kratom products. The age limit differs by state.
For example, in Colorado and Tennessee you must be at least 21 years of age to purchase Kratom.
In New Hampshire and North Carolina, the age limit is 18.
