Ohio State Kratom Law

Kratom Is currently legal in Ohio. There is House Bill 236 passed the Ohio House of Representatives on February 9, 2022, by an 83-10 vote. It has been referred to the Senate Health Committee where it remains pending. Benesch will monitor the legislation as it progresses.

 

Advocates are actively working so that Kratom remains legal.


If you would like to help protect Kratom please look into the American Kratom Association. The AKA has organized the American Kratom Protectors. They are a national grassroots organization that will help lead the advocacy efforts as we fight state bans, share correct information about Kratom, and push passage of state and federal Kratom Consumer Protection Acts.

Due to the herb being unregulated by the Food & Drug Administration, some states are concerned about Kratom leading to addiction. More research is being conducted on this plant daily, and in the meantime, rules and regulations are continuously being updated.

The Transportation Security Administration (TSA) oversees security and has specific rules regarding various items, including Kratom. 

While it's not a prohibited item, Kratom powders over 12 oz will be placed in a separate bin for X-ray screening. You can bring Kratom in your carry-on or checked luggage, but we recommend clearly labeleling the product to avoid any confusion.

Keep Kratom in its original packaging if possible.

Laws widely vary outside of the U.S. You will have to do some research beforehand to see which countries have banned Kratom. 

A handful of countries where Kratom is ILLEGAL include:

Denmark, Finland, France, Germany, Ireland, Israel, Japan, Malaysia, Poland, Russia, Singapore, South Korea, Sweden, Switzerland, Thailand, and Vietnam.

There is no federal minimum age to purchase Kratom products. The age limit differs by state.

For example, in Colorado and Tennessee you must be at least 21 years of age to purchase Kratom.

In New Hampshire and North Carolina, the age limit is 18.
