Indiana Kratom Laws: Was It Always Illegal?

Not always, no. Before 2014, Kratom was legal in Indiana. However after the House Bill 1542 was enacted, Kratom’s alkaloids were classified as ‘synthetic drugs’. And since then, Indiana has maintained the ban in the state, even when there were attempts to change the scenario.

So, let’s first understand the details. After the bill classified Kratom’s primary alkaloids as synthetic substances, it made all Kratom products illegal to sell or possess, whether online or offline. And by citing concerns about its opioid-like effects and possible addiction risks, the lawmakers justified the move to ban it altogether.

Nine years later, in 2023, with House Bill 1500, there was an attempt to legalize Kratom in Indiana or at least regulate it. It successfully passed the House of Representatives with a vote of 53-40.  However, when forwarded to the Senate Committee for further consideration, it did not proceed with any actions regarding changing the rules. • It made the sale of Kratom to minors a criminal offense.

Due to the lack of proven research, the Food and Drug Administration (FDA) has been clear about its concerns over Kratom’s safety. The agency has been vocal about its potential for abuse, and only more research can lead to any reconsideration. The FDA maintained that protecting Indiana’s residents was its priority, especially with the danger of synthetic versions potentially entering the market.
